1. Sweepstakes Entry Period: The Hunt Brothers Pizza Free Fill Up Sweepstakes (“Sweepstakes”) begins at 12:01 AM Central Daylight Time (“CDT”) on August 23, 2008, and ends at 11:59 PM CDT on October 27, 2008 (“Sweepstakes Entry Period”). Sponsor: Hunt Brothers Pizza, LLC, 4020 Jordonia Station Road, Nashville, TN 37218.
2. Eligibility: Sweepstakes is open to legal residents of the 50 United States and the District of Columbia age 18 or older as of the commencement of the Sweepstakes Entry Period. Employees of Sponsor, Gish Sherwood & Friends (“Agency”), and their respective parents, subsidiaries, affiliates, retail owners and their respective employees, advertising and promotion agencies and their immediate family members and/or those living in the same household of each are not eligible to enter or win. Sweepstakes governed by U.S. law. Sweepstakes is subject to all applicable federal, state and local laws and regulations.
3. To Enter: Visit www.freegasfreepizza.com, and follow all entry instructions to complete, and submit the online entry form (“Online Entry”). Limit: One Online Entry per email address during Sweepstakes Entry Period. All Entries must be received by 11:59 PM ET by October 27th, 2008. Entrants subject to all notices posted online including, but not limited to, privacy policy. If any entrant attempts to enter the Sweepstakes more than once, then all entries tied back to that entrant will be disqualified. Should a dispute arise regarding the identity of the entrant, the authorized account subscriber of said e-mail account at the time of entry will be considered the entrant. “Authorized Account Subscriber” as it relates to email is defined as the natural person who is assigned an e-mail address by an Internet access provider, on-line service provider or other organization, which is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. Illegible or mechanically reproduced entries are not eligible. All entries and requests become Sponsor's property and will not be returned or acknowledged. Sponsor is not responsible for lost, late, damaged, or misdirected entries.
4. Grand Prize: (1): A $3,510 cash prize (awarded in the form of a check) and fifty-two (52) $10 Hunt Brothers Gift Certificates. Approximate Value of Grand Prize: $4030.00.
Gift certificate subject to terms, conditions and expiration dates (if any) printed on gift certificate. Hunt Brothers certificates not redeemable for cash and no cash refund for any unused portion of any of the certificates. Certificates are non-transferable and void if sold or bartered.
Odds of winning depend on the number of eligible entries received during the Sweepstakes Entry Period. Grand Prize Winner (“winner”) is responsible for all taxes on prize. Prize is non-assignable and non-transferable except to a surviving spouse. If selected winner is unable to accept the prize, the selected winner will forfeit the prize and the prize will be awarded to an alternate winner in separate random drawing among all non-winning eligible entries. Acceptance of prize constitutes permission (except where prohibited by law) to use winner's name, prize won, hometown, likeness, photograph, voice, address (city and state) and biographical information for purposes of advertising, online posting, promotion and publicity without additional compensation. Prize is guaranteed to be awarded, assuming a sufficient number of entries are received.
5. Winner Selection: Winner will be selected in a random drawing from all eligible entries received. Random drawing will be conducted on or about November 2, 2008 under supervision of an independent judging organization whose decisions are final. Winner will be notified by mail and/or telephone and will be required to complete and return an Affidavit of Eligibility/Liability and Publicity Release (“Affidavit/Release”) within fourteen (14) days of date specified on notification or an alternate winner will be selected at random. If an Affidavit/Release or prize notification is returned as undeliverable, it will result in disqualification, and the prize will be awarded to an alternate winner in a separate random drawing. The Sponsor reserves the right to modify the notification procedures in connection with the selection of alternate winner.
6. Releases: BY PARTICIPATING IN THIS SWEEPSTAKES, YOU ACCEPT ALL RISKS AND CONSEQUENCES OF ENTRY AND PARTICIPATION IN THIS SWEEPSTAKES AND AGREE TO RELEASE AND HOLD HARMLESS THE SPONSOR AND ALL ENTITIES INVOLVED IN THE SWEEPSTAKES (“PROMOTIONAL PARTIES”) AND THEIR RESPECTIVE OFFICERS, DIRECTORS, SHAREHOLDERS, EMPLOYEES, REPRESENTATIVES, AGENTS, SUCCESSORS AND ASSIGNS FROM ANY AND ALL CONSEQUENCES, LIABILITY, LOSSES, DAMAGES (INCLUDING WITHOUT LIMITATION, CONSEQUENTIAL, PUNITIVE, INCIDENTAL, SPECIAL OR INCREASED DAMAGES AND THOSE RELATED TO PERSONAL INJURY, DEATH OR DAMAGE TO PROPERTY) AND COSTS AND EXPENSES, OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING FROM OR RELATED TO THIS SWEEPSTAKES, INCLUDING BUT NOT LIMITED TO YOUR ENTRY AND PARTICIPATION IN THE SWEEPSTAKES, THE ACCEPTANCE AND/OR USE (OR MISUSE) OF ANY PRIZE, PRINTING ERRORS AND ANY CLAIMS BASED UPON THE RIGHTS OF PUBLICITY AND INVASION OF PRIVACY, EVEN IF ONE OR MORE OF THE PROMOTION PARTIES OR ANY OF THE OTHER RELEASED PARTIES WERE AWARE OF THE POSSIBILITY OF ANY SUCH CONSEQUENCES, LOSSES, DAMAGES, ETC..
WITHOUT LIMITING THE FOREGOING, YOU FURTHER AGREE THAT NEITHER SPONSOR NOR ITS AFFILIATES, AND THEIR RESPECTIVE OFFICERS, DIRECTORS, SHAREHOLDERS, EMPLOYEES, REPRESENTATIVES, AGENTS, SUCCESSORS AND ASSIGNS, SHALL BE LIABLE FOR ANY DAMAGES, LOSSES, COSTS OR EXPENSES, OF ANY KIND, ARISING FROM OR RELATED TO CIRCUMSTANCES BEYOND THE REASONABLE CONTROL OF SPONSOR, PROMOTIONAL PARTIES NOR THEIR AFFILIATES, AND THEIR RESPECTIVE REPRESENTATIVES AND AGENTS, INCLUDING BUT NOT LIMITED TO ACTS OF GOD, ACTS OF GOVERNMENT, ACTS OF TERROR, ACTS OF WAR, CIVIL UNREST, LABOR SHORTAGES AND/OR STRIKES, EVEN IF ANY ONE OR MORE OF THE PROMOTION PARTIES OR ANY OF THE OTHER RELEASED PARTIES WERE AWARE OF THE POSSIBILITY OF ANY SUCH EVENTS OCCURRING.
7. Miscellaneous: Entry materials/data that have been tampered with or altered, or mass entries or entries generated by a script, macro or use of automated devices are void. The Sponsor is not responsible for: (i) lost, late, misdirected, damaged, or illegible entries; or (ii) error, omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of entry materials, or for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions of any kind, or inaccurate transmission of or failure to receive entry information by Sponsor on account of technical problems or traffic congestion on the Internet or at any web site or any combination thereof; or (iii) any injury or damage to entrant’s or any other person’s computer related to or resulting from participating in the Sweepstakes. By participating in the Sweepstakes, you (i) agree to be bound by these Official Rules, including all eligibility requirements, and (ii) agree to be bound by the decisions of the Sponsor and the independent judging organization, which are final and binding in all matters relating to the Sweepstakes. Failure to comply with these Official Rules may result in disqualification from the Sweepstakes. Sponsor, in its sole discretion, reserves the right to: (i) permanently disqualify from any Sweepstakes it sponsors any person it believes has intentionally violated these Official Rules; (ii) withdraw the online method of entry if it becomes technically corrupted (including if a computer virus or system malfunction inalterably impairs its ability to conduct the Sweepstakes), and to select winner from among all eligible entries received prior to withdrawal.
Legal Warning: ANY ATTEMPT BY AN individual, whether or not an ENTRANT, TO DELIBERATELY DAMAGE, destroy, tamper or vandalize this WEB SITE OR interfere with the OPERATION OF THE SWEEPSTAKES, IS A VIOLATION OF CRIMINAL AND CIVIL LAWS and SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES and diligently pursue all remedies against ANY SUCH individual TO THE FULLEST EXTENT PERMITTED BY LAW.
8. Winner’s List. For the name of the winner (available after November 29, 2008), log on to www.freegasfreepizza.com between December 1, 2008 and January 16, 2009.
